Terms and Conditions

1. Agreement

These Terms and Conditions govern your access to and use of Saka Logistics, including our customer app, driver app, dashboards, website, backend services, messaging, payment, support, and shipment-related features.

By creating an account, accepting these Terms in the app, requesting a shipment, making an offer, accepting a shipment, using a dashboard, or otherwise using Saka Logistics, you agree to these Terms.

This draft should be reviewed by qualified legal counsel before publication as final legal terms.

2. Our Role

Saka Logistics is a logistics marketplace and technology platform. We connect customers who need goods transported with independent drivers, fleet managers, and logistics businesses that may quote, accept, pick up, transport, and deliver shipments.

Unless we expressly state otherwise in writing for a specific service, Saka Logistics is not the direct carrier for every shipment and does not employ every driver, fleet manager, or logistics provider using the platform.

Drivers, fleet managers, and logistics businesses are responsible for their own lawful operations, licenses, vehicles, personnel, safety practices, and transport obligations.

3. Accounts and Eligibility

You must provide accurate, current, and complete registration, contact, identity, business, vehicle, shipment, and payment information. You must keep that information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We may require email or phone OTP verification, identity verification, driver verification, business verification, document review, or other checks before allowing access to certain features.

We may refuse, limit, suspend, or terminate access where information is inaccurate, verification fails, conduct is unsafe or unlawful, payment is not completed, or these Terms or platform policies are breached.

4. Customer Responsibilities

Customers are responsible for providing accurate shipment details, including package description, weight, dimensions, images, pickup and delivery locations, handling instructions, budget, timing, and access requirements.

Customers must ensure goods are lawful to transport, properly packaged, safe to handle, and ready for pickup. Customers must not misdeclare goods or hide information that affects price, safety, legality, handling, or delivery.

Customers are responsible for ensuring pickup and delivery contacts are available and authorized to release or receive goods.

5. Driver, Fleet, and Business Responsibilities

Drivers, fleet managers, and logistics businesses are responsible for lawful operation, valid licenses, vehicle fitness, insurance where required, safe driving, safe handling, timely pickup and delivery, accurate offers, and compliance with applicable transport, tax, labor, road safety, and business laws.

Drivers and logistics providers must only accept shipments they are able and authorized to complete. They must follow agreed shipment instructions, communicate truthfully, protect goods in their care, and update shipment status honestly.

Fleet managers and business users are responsible for drivers, vehicles, documents, staff access, and business profiles they manage through the platform.

6. Prohibited and Restricted Goods

You must not request, accept, transport, or assist with shipment of illegal items, stolen goods, counterfeit goods, weapons, explosives, unauthorized hazardous materials, controlled substances, or anything that violates applicable law or platform policy.

You must not ship cash, high-value goods, fragile goods, live animals, perishables, medical items, chemicals, or regulated goods unless they are expressly accepted for that shipment and can be transported lawfully and safely.

We may cancel, report, refuse, suspend, or otherwise act on shipments that appear unsafe, unlawful, fraudulent, misdeclared, or prohibited.

7. Offers, Pricing, Payments, and Refunds

Customers may create shipment requests and receive offers or counter-offers from drivers, fleet managers, or logistics businesses. Prices may depend on package details, distance, vehicle type, timing, handling requirements, availability, and other operational factors.

A shipment may become binding when an offer is accepted, payment is completed where required, and the platform confirms assignment or acceptance. Payment flows may use external payment providers and mobile money channels.

Refunds, cancellations, failed payments, partial performance, disputes, non-refundable amounts, service fees, and payment reversals may be reviewed by Saka Logistics, the payment provider, and relevant administrators. Exact refund and cancellation rules may vary by shipment, payment status, provider rules, and business policy.

All prices are expected to be handled primarily in Tanzanian shillings unless otherwise shown.

8. Shipment Tracking and Communications

Shipment statuses, tracking numbers, timelines, chat messages, notifications, and location updates are provided to support coordination and visibility. They may be delayed, inaccurate, incomplete, unavailable, or interrupted because of network conditions, device settings, GPS availability, user actions, or service limitations.

Users must keep communications respectful, truthful, relevant, and lawful. You must not use chat, support, ratings, reviews, or reports to harass, threaten, defraud, abuse, impersonate, spam, or mislead others.

9. Ratings, Reviews, Reports, and Support

Customers, drivers, and logistics providers may submit ratings, reviews, support reports, comments, images, and related information. These submissions must be honest, respectful, and based on real platform experiences.

We may review, moderate, remove, restrict, or investigate content that appears abusive, fraudulent, unlawful, misleading, unsafe, or unrelated to the service.

10. Suspension and Enforcement

We may suspend, restrict, deactivate, or terminate accounts or access to features if we believe a user has breached these Terms, failed verification, provided false information, engaged in unsafe conduct, failed to pay, abused the platform, transported prohibited goods, committed fraud, or violated applicable law.

We may also preserve records, cooperate with lawful requests, reverse or hold transactions where appropriate, and take steps needed to protect users, goods, the platform, and the public.

11. Liability and Disclaimers

Saka Logistics is provided on an as-is and as-available basis. We do not guarantee uninterrupted service, exact tracking, availability of drivers, acceptance of shipments, delivery times, or error-free operation.

To the maximum extent allowed by applicable law, Saka Logistics is not responsible for indirect, incidental, special, consequential, or punitive damages. Responsibility for lost, damaged, delayed, misdeclared, prohibited, or unlawfully transported goods may depend on the facts of the shipment, provider responsibility, insurance coverage, applicable law, and any separate written agreement.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

12. Legal Acceptance and Changes

Saka Logistics may record legal acceptance details such as the accepted terms version, privacy version, source, timestamp, and related account information.

We may update these Terms from time to time. When required, we may ask users to accept a new version through the app or service before continuing to use certain features.

13. Governing Law and Contact

These Terms are intended to be governed by the laws of Tanzania unless a different governing law is required by an applicable written agreement or mandatory law.
